Terms & Conditions – Hillside The Label B.V.

Article 1 – Definitions

For the purposes of these Terms & Conditions, the following definitions apply:

1.1 Company: Hillside The Label B.V., located at Struisgras 41, 1441 WC Purmerend, The Netherlands, registered with the Dutch Chamber of Commerce under registration number 37112444.

1.2 Customer: Any natural person acting outside the scope of a trade, business, craft, or profession who enters into an agreement with the Company.

1.3 Distance Contract: An agreement concluded between the Company and the Customer through an organized system for distance selling, using one or more means of remote communication up to and including the conclusion of the agreement.

1.4 Withdrawal Period: The period during which the Customer may exercise the right of withdrawal.

1.5 Product: All clothing, accessories, and related items offered by Hillside The Label B.V. through its online store.


Article 2 – Applicability

2.1 These Terms & Conditions apply to every offer made by Hillside The Label B.V. and to every distance contract concluded between the Company and the Customer.

2.2 Before the distance contract is concluded, these Terms & Conditions will be made available to the Customer.


Article 3 – The Offer

3.1 All product descriptions are provided as accurately and completely as possible.

3.2 Obvious errors or mistakes in the offer are not binding on the Company.

3.3 Each offer contains sufficient information to ensure that the Customer understands the rights and obligations associated with accepting the offer.


Article 4 – The Agreement

4.1 The agreement is concluded when the Customer accepts the offer and complies with the applicable conditions.

4.2 The Company will promptly confirm receipt of the Customer’s acceptance electronically.


Article 5 – Right of Withdrawal

5.1 The Customer has the right to withdraw from the agreement without providing any reason within 14 days of receiving the product.

5.2 During this period, the Customer must handle the product and its packaging with reasonable care.

5.3 If the Customer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging.

5.4 Return shipping costs are the responsibility of the Customer unless otherwise agreed.


Article 6 – Exclusion of the Right of Withdrawal

6.1 The right of withdrawal does not apply to products that cannot be returned for hygiene reasons once the seal has been broken, including but not limited to underwear and swimwear.


Article 7 – Prices

7.1 All prices are stated in euros (€), including VAT and excluding shipping costs unless otherwise indicated.

7.2 Prices are subject to correction in the event of obvious errors, inaccuracies, or pricing mistakes.


Article 8 – Delivery and Performance

8.1 The Company will exercise the utmost care when receiving and processing orders.

8.2 Products will be delivered to the address provided by the Customer.

8.3 In the event of a delay in delivery, the Customer will be informed as soon as reasonably possible.


Article 9 – Payment

9.1 Payments must be made using one of the payment methods offered through the online store.

9.2 The Customer is responsible for immediately reporting any inaccuracies in payment details provided to Hillside The Label B.V.


Article 10 – Warranty and Conformity

10.1 Hillside The Label B.V. guarantees that its products conform to the agreement, product specifications, and reasonable standards of quality and usability.

10.2 Any defects or issues must be reported in writing within 7 days of discovery.


Article 11 – Complaints Procedure

11.1 Complaints must be submitted clearly and in full via info@hillsidethelabel.nl.

11.2 Hillside The Label B.V. will respond to complaints within 14 days of receipt.


Article 12 – Liability

12.1 The Company shall not be liable for indirect damages, consequential damages, or loss of profit.

12.2 The Company's liability is limited to the purchase value of the relevant product.


Article 13 – Governing Law

13.1 All agreements are governed exclusively by the laws of the Netherlands.

13.2 Any disputes shall, where legally permitted, be submitted to the competent court in the district where the Company is established.
